Return and Guarantee Policy

Introduction

Center for Oncology in Pediatrics Foundation is the fundraising and awareness organization for the Centro Oncologico Pediatrico de Baja California, A. C. Hospital located in Tijuana, State of Baja California, Mexico. Center for Oncology in Pediatrics Foundation is a California 501 (c)(3) non-profit, U. S. tax-exempt organization which exists solely to raise and provide international grants necessary to fund, operate and maintain the Centro Oncologico Pediatrico de Baja California, A. C. Hospital whose mission is to treat children with cancer free of charge.  We comply with all U. S. charitable giving regulations, satisfy IRS guidelines for international grant-making and tax deductibility and follow Treasury Department guidelines regarding anti-terrorism.

We Seek a Fair and Transparent Refund Process

We actively seek to have all of our donors have a positive online gifting and online donation experience with our foundation and the hospital we benefit.  Thus, the Center for Oncology in Pediatrics Foundation is instituting an online gift and online donation refund policy to ensure a fair and transparent process for requesting a refund for donations made as digital payments are becoming more frequent.  

The Center for Oncology in Pediatrics Foundation expects that all donors will exercise due care and diligence while making donations and recognize that an online gifts or donation may be made erroneously in either the amount of payment or payee or both. We will examine all requests for refunds of online gifts and online donations and endeavor to make the refund.   We may also seek proper explanation and reason from the user as well as require further verification via original proof documents. Additionally, it is important to note that the Center for Oncology in Pediatrics Foundation is generally not obliged to make refunds and may, at its discretion, decline any requests for refund of donations, particularly if a tax exemption certificate has been issued.

Request of Refund within the Same Month of Donation Made

Any donor who makes an online contribution at www.copfoundation.org and is not satisfied with: a) their giving experience, or b) there is an error in the amount of payment made or to the payee, you may process a refund by contacting the Center for Oncology in Pediatrics Foundation at 1-619-489-1427 or 1-866-928-7831 within the same month the online gift or donation was made.  If a Tax Donation Receipt was issued, this will need to be returned to us, it will be voided and your IRS Tax Deductibility will not be applicable.

The refund process may take between 7 to 30 working days depending on the availability of the information from third parties such as Payment Gateway, Banks, etc. through which transaction is done.

Request of Refund within the Following Month of Donation Made and Before the end of the Current Fiscal Year

Any donor who makes an online contribution at www.copfoundation.org and is not satisfied with: a) their giving experience, or b) there is an error in the amount of payment made or to the payee and you wish to process a refund in the following month of the date of the online gift or online donation was made and or before the end of the current fiscal year, you will need to invoke our Center For Oncology in Pediatrics Foundation Guarantee as detailed below.

Satisfaction Guaranteed - Center for Oncology in Pediatrics Foundation Guarantee

A refund request made in the following month of the date on which the online gift or online donation was made and or before the end of the current fiscal year, will receive a refund in the form of a Center for Oncology in Pediatrics Gift Certificate equal to the value of the original online gift or online donation, up to $10,000 per donor per year.  The issuance of the guarantee process may take between 7 to 30 working days depending on the availability of the information from third parties such as Payment Gateway, Banks, etc. through which transaction is done.

Terms and Conditions

The Guarantee can be activated at any time during the following month of the date the online gift or online donation was made and or before the end of the current fiscal year by contacting Center for Oncology in Pediatrics Foundation. Anyone making a request of an online gift or online donation under these terms and conditions, can take advantage of the guarantee. However, Center for Oncology in Pediatrics Foundation employees and their immediate families, board members, project leaders, staff of the project organization, board members and or staff of our sister-foundation in Tijuana and family members of these persons are not eligible.

Why a Gift Certificate vs. Cash Back?

For legal reasons, Center for Oncology in Pediatrics Foundation must award a Gift Certificate, instead of cash back, to any donor invoking the guarantee. Here’s why: For a donor to receive the benefit of a tax deduction, the IRS requires there be a clear transfer of “control and discretion” of the funds to Center for Oncology in Pediatrics Foundation. U.S. laws and regulations prevent any 501(c)3 organization from giving up this control and discretion.

In other words, the issue for regulators is that they recognize that when a donor gives money to a nonprofit organization, that money is no longer the donors once accepted by the charity. Instead, the money is, in effect, owned by the public interest. Because nonprofit organizations exist to benefit the public interest, regulators will be concerned that gifts are used to further the public interest. Returning a donor’s gift could be contrary to the public interest.  

Further, once a donor has claimed tax deductibility, “reversing” it is problematic, particularly if the donation is made in one year and the guarantee is called in the following year. For these reasons, we are issuing a Gift Certificate equal to the amount of the original donation.

We will continue to monitor these laws and regulations with a view toward making Center for Oncology in Pediatrics Foundation Guarantee the most comprehensive possible.

The project benefited by the donations received by the Center for Oncology in Pediatrics Foundation has gone through a rigorous due diligence review, comply with U. S. charitable giving regulations, satisfy IRS guidelines for international grant-making and tax deductibility and follow Treasury Department guidelines for anti-terrorism.  The result is a fully accountable project that achieves maximum impact for all our donors who seek to make donations that may applied internationally to save lives for children in dire need of medical treatment.

With the Center for Oncology in Pediatrics Foundation, an approved 501 (c)(3) public charity, please be certain that your contributions will be lawful, fully tax-deductible and used responsibly while seeking to support the causes you are most enthusiastic about.  The Center for Oncology in Pediatrics Foundation management ensures that your funding, via our international grants, is properly used by the Centro Pediatrico de Baja California, A. C. programs. Our foundation will provide financial reports to our donor base detailing the use of the funds as well as the impact they have created.
